Gift Card Terms

TERMS AND CONDITIONS FOR THE USE OF GIFT CARDS

1.    GENERAL PROVISIONS

1.1. These Terms and Conditions set out the conditions for the use of Gift Cards in the Online Store available at the internet address: https://ligaskrakow.com. A Gift Card is not a standalone good or service in itself, but merely a document entitling its bearer to purchase a Product on the conditions stated on it. The provisions of the Online Store terms and conditions concerning the sale of Products apply accordingly to the purchase of Gift Cards.

1.2. The issuer of the Gift Card is the Seller, Ligas Krakow Sp. z o.o., ul. Lipowa 3D, 30-702 Kraków, NIP (Tax ID) 6793278212

1.3.  All capitalised terms used in these Terms and Conditions that are not defined below are to be understood in accordance with their definitions set out in the Online Store terms and conditions.

1.4.  Definitions:

• GIFT CARD – a voucher with a value stated on it, entitling the Customer to make cashless purchases of Products available in the Online Store in accordance with these Terms and Conditions, within the period indicated on it and up to the nominal value recorded on it. The Gift Card certifies the Holder's right to use it to make payment under a Sales Contract for Products purchased in the Online Store.
• CUSTOMER, HOLDER – (1) an adult natural person with full legal capacity; (2) a legal person; or (3) an organisational unit without legal personality on which the law confers legal capacity — who is in possession of a Gift Card and concludes, or intends to conclude, a Sales Contract using it.
• PRODUCT – a movable item available in the Online Store that may be purchased by the Customer using a Gift Card.
• TERMS AND CONDITIONS – these terms and conditions for the use of Gift Cards.
• SALES CONTRACT – a contract of sale of a Product that may be concluded between the Customer and the Seller using a Gift Card in the Online Store.

2.    CONDITIONS FOR USING GIFT CARDS

2.1. The Gift Card is issued to the bearer and may be used by its Holder exclusively when purchasing Products in the Online Store belonging to the Seller. The Gift Card replaces cash up to the nominal value recorded on it and enables payment under a Sales Contract, including the costs of delivery of the Product.

2.2. The Gift Card is issued and sent to the Customer in electronic form, via a message sent to the e-mail address provided by the Customer when purchasing the Gift Card in the Online Store.

2.3. The Gift Card has a unique identification code registered in the Seller's system.

2.4. To use a Gift Card, when placing an Order enter the unique identification code stated on the Gift Card in the appropriate field of the Order Form and confirm it by clicking the action button available next to that field. Once the code has been confirmed, the value of the purchases in the cart will automatically be reduced by the funds available on the Gift Card.

2.5. The Gift Card is valid for a period of 12 months from the date of its issue (i.e. the date of purchase of the Gift Card by the Customer), before the expiry of which it should be redeemed in the Online Store. The expiry date is additionally indicated in the content of the Gift Card. After the expiry date, the Holder is no longer able to make payments using the Gift Card.

2.6. The Gift Card may be issued for various values, depending on the Customer's choice. Detailed information about the available Gift Card denominations is provided on the pages of the Online Store.

2.7. The Holder of a Gift Card is entitled to use the Gift Card multiple times in the Online Store to purchase one or more Products, but no more than up to the nominal value recorded on the Gift Card and no later than before its expiry date.

2.8. In the case of a Sales Contract whose value is lower than the nominal value recorded on the Gift Card being redeemed, the funds available on the Gift Card are automatically reduced by the value of the purchase made using it. The funds remaining on the Gift Card may be used for as long as the Gift Card's validity period has not expired.

2.9. The Customer is also entitled to redeem the Gift Card in the case of a Sales Contract whose value exceeds its nominal value, provided that in such a case the Customer is obliged to pay the remaining part of the price using other available payment methods.

2.10. The Gift Card is not exchangeable for a cash equivalent (in whole or in part) or for any other form of compensation. The value of the Gift Card does not bear interest and is not subject to indexation.

2.11. A Gift Card cannot be used to purchase another Gift Card.

2.12. If the Customer returns a Product purchased using a Gift Card (e.g. as part of a consumer's withdrawal from the contract), the Seller refunds the price paid onto the Gift Card. If the Order was paid for partly using another payment method, the remaining part of the price is refunded by the Seller in accordance with the payment method chosen by the Customer, or in another manner agreed with the Customer.

2.13. Gift Cards may be used to purchase Products covered by sales, discounts and promotions organised in the Online Store, unless the terms of the particular sale, promotion or discount provide otherwise.

2.14. Nothing in this section 2 of the Terms and Conditions is intended to exclude or limit any statutory rights of a Customer who is a consumer (and, from 1 January 2021 and for contracts concluded from that date, also of a Customer who is a natural person referred to in art. 385[5] Kodeksu Cywilnego (Polish Civil Code)), granted by mandatory provisions of law, in particular with respect to withdrawal from a distance contract.

3.    COMPLAINTS PROCEDURE

3.1. Complaints related to the use of a Gift Card and the implementation of these Terms and Conditions may be submitted by the Customer, for example, by e-mail to: contact@ligaskrakow.com or in writing to: ul. Lipowa 3D, 30-702 Kraków. Complaints concerning purchased Products may be submitted by the Customer in accordance with the rules set out in the Online Store terms and conditions, which are available on its pages.

3.2. It is recommended that the description of a complaint include as much information and detail as possible concerning the subject of the complaint, in particular the type and date of the irregularity, the expectations of the Customer / Holder as to how the complaint should be resolved, and the contact details of the person submitting the complaint — this will facilitate and speed up the handling of the complaint by the Issuer.

3.3. The Issuer responds to a complaint promptly, no later than within 14 days of its submission.

4.    FINAL PROVISIONS

4.1.  These Terms and Conditions are governed by Polish law.

4.2.  The Issuer reserves the right to amend these Terms and Conditions for important reasons, such as: changes to the operation, form of issue, denominations or validity periods of Gift Cards, or the need to adapt these Terms and Conditions to changes resulting from amendments to the Online Store terms and conditions — provided that no amendments to the Terms and Conditions will affect the rights acquired by the Customer / Holder before the amendment, including in particular Gift Cards already issued.

4.3.  In matters not regulated in these Terms and Conditions, the provisions of the Kodeks Cywilny (Polish Civil Code) and other applicable provisions of Polish law apply.
